Frequently Asked Questions

FAQs

How will you keep in touch with me and let me know what’s going on?

We want you to be a client and a friend, but we don’t need to see you very often. After your initial meeting or consultation with us, we will try to limit face-to-face meeting time. As small business owners ourselves, we recognise your time is valuable. We will use email to inform you of any new developments in your case and we usually phone you when seeking your input.

As Sydney business lawyers, we can prepare an ‘exit plan’ for you that minimises disputes with the remaining partners or shareholders, and clearly outlines your position to the other partners or shareholders from the outset.

A litigation lawyer can represent you in court or arrange a barrister to represent you in court, depending on your needs and circumstances, and the nature and complexity of the case.

It depends. The complexity of the issues, and the type and amount of evidence are factors we consider to give you an estimate of the costs of starting or defending litigation. The costs of going to court include our professional fees and fees of any barrister briefed in your case, the court filing fee, the court hearing fee and any applicable expert’s reports.

Before taking a matter to court, we can explore with you the possibility of a negotiated outcome not involving litigation. A letter of demand, or responding to a letter of demand, before going to court is one way of identifying the scope of the dispute and whether it may be possible to try and resolve the matter by way of alternative dispute resolution such as mediation.

We do not offer payment plans. However, third-party providers of cash flow management solutions can enter into an arrangement with you whereby they pay the legal fees upfront, and you repay them through instalments. Such third-party providers include litigation funding.
